Dear Moromarino

I am just going to warn you right now, your upload of these file are the exact same publisher and editor edition I uploaded two years ago and it most likely is going to be deleted. Funny thing is it was one of my first uploads too on the site. The problem here is James M. Beale (1924-2010) (you can check my Talk page, very first post, sort of repeating what this I am writing) and he died less than 50 years ago, which means this edition (your score and parts) is not eligible until at least 2051 in Canada. We still don't know what the extant of the contributions he made on the parts and that is why it probably will be deleted. Just because Webern entered the public domain in the EU this year (life + 70) DOES NOT mean this piece is magically somehow public domain, its the editor that is the sticking point here.

Sallen is correct. This is not an urtext edition and Beale lived until 2010. We have to delete these files as they are under copyright worldwide.

Hey Carolus do you know if there is an expert we can contact to clear up this issue regarding the extant of the additions in this edition? Because if we can find out and prove that the additions made by Beale aren't significant enough, then we can have the piece up on here. I think this is probably the only published edition of this piece. It would be PD-CA if it wasn't for Beale.

Thank you all for the info!

Honestly, I had my doubts, but I've decided to upload the files anyway.

Just a question (for me, to avoid having this same situation again in the future): Composition and edition date should be both pre-1946 (70 years) to stay on the website? What about modern Urtext editions (Bärenreiter/Henle)? I would like to upload a lot more stuff and I'll appreciate if I could finally understand these copyright issues. Thanks!

You should read through this page: http://imslp.org/wiki/Public_domain

Thanks! I've read everything. Also the "Copyright made simple" page. I am checking now all the copyright status of all the works that I intended to upload. Sadly, most of them have the same editor's death date issue. I have a doubt with a particular one: Benno Sachs / Arnold Schönberg Chamber Ensemble arrangement of Prélude à l'après-midi d'un faune by Debussy might be uploadeable? Sachs and Schönberg died long time ago but the first publication of this arrangement was in 1980 (Belmont Music)...

Well you could try and upload the piece. It could be PD in the USA (if it was first published before 1923) due to the fact that Sachs died in 1920 (if that is his death date) but also could be PD in Canada. Do you know when the first edition (year of publication) was of this arrangement? If it was first published before 1923, it might be eligible in the USA. If after 1923, then it might be eligible Canada. Carolus would be able to check and tell you if this is eligible if you ask him. I am not a copyright expert and pieces like this are complicated sometimes to figure out there status on them. Had to deal with this numerous times with Hindemith...
