EU directive on Critical Editions

Dear Max,

Here is the link to Directive 2006/116/EC. Under Article 5, note the following text with respect to critical editions: "Member States may protect critical and scientific publications of works which have come into the public domain. The maximum term of protection of such rights shall be 30 years from the time when the publication was first lawfully published." It alllows member states to protect such editions, but only for a maximum term of 30 years from publication. it does not require member states to protect such editions at all, form what I can see. As far as I know, the longest term for such editions in force is that of Germany (section 70), which is 25 years. Italy sets the term at 20 years, and the UK has a typographic copyright of 25 years. Thinking about how often laws can change - and how long it takes for us to find out about it - I can see where it might be a good idea to employ the C* tag for items 25-30 years old. Mendelssohn, Op.42

Hi Max, The engraving on this score appears to have been done well before the 1980s. It really looks like something that might have been produced as early as the 1910s or as late as 1970 by the Leipzig gnomes. It looks to me that the Wiesbaden folks removed the English text and stripped in German, or possibly replaced an earlier, heavier typesetting of the German text with a more modern-looking typeface. There's no editor credit, and no copyright claim. I am therefore tagging it V/V/V. Thank you very much for the lovely IMSLP.eu tshirts, which arrived in perfect condition!
