  • Please note that the IMSLP makes no guarantee whatsoever that the information appearing here is legally accurate and assumes no liability or legal responsibility therefor.
  • Due to the voluntary 25 year rule (2016 - 25 - full calender year), most of the volumes below are still copyrighted after 1990 and cannot be uploaded here. As of 2016, any of the volumes published before 1990 can be uploaded due to this collection in general being not original and that they are considered critical editions. Prefaces must be removed however due to the corresponding editor may be still alive of the volumes below. In the case for this series, each individual piece from a set in a single volume will be governed by whether it was originally first performed, published or delivered (Copyright stamps at the bottom of each piece in the volumes can help determine the first publication originally for the individual piece). As most pieces of this series of Hindemith were previously published separately in separate editions before this series began, some pieces were first published in this series for the first time due to the pieces either being lost or never published by Hindemith himself during his lifetime and that the piece may not have a performance date determining copyright status in certain countries, which may be then still copyrighted. Librettists, translators, editors, etc. of individual pieces in the volumes by their death date's have to be considered also for copyright.
  • Under Canadian law, a work must contain a sufficient amount of original material to qualify for copyright protection - which is usually described as the "threshold of originality." Works which consist of collation and comparison of public domain sources, though they often require intensive research and scholarship, fail to meet this test under the copyright statutes of many nations around the world, including Canada. However, the determination of originality is ultimately up to a court, since there is no specific language in the Canadian statute explicitly defining which items are considered original enough to meet the "threshold of originality" on a given editor's part. It is also true that such editions have been granted a special, limited-term, copyright in certain countries (notably Germany and Italy), and in the EU itself. IMSLP, though it is under no sort of legal obligation to do so, therefore voluntarily enforces a term of 25 years from date of publication for such modern, scholarly editions, which originate in the European Union.
  • Before its 1989 demise, the Hungarian communist state published works of living or deceased persons on which the state claimed copyright. Editio Musica Budapest (founded in 1950) was a government agency formed by government expropriation of privately-owned publishing firms like Roszavolgyi, Rozsnyai, and others at the start of the Soviet occupation. Although original works of contemporary Hungarian composers have been judged to be the vaild copyrights of the composers themselves or their heirs in most Western countries, urtext or critical editions published during this era (1945-1989) have not been considered to be subject of copyright, as such editions were prepared by government employees working for a state agency as part of their employment - thus government works. Moreover, the copyright owner itself (the Hungarian communist government) ceased to exist. See this section on USSR editions for more information.
  • Additionally, Section 70 of the German copyright law states that scientific editions (editions which are produced as a result of scientific analysis, i.e. urtext) are entitled to only a limited copyright term of publication plus 25 years. See this for more information. (Article 5 of the EU Copyright Directive 93/98/EC specifically limits the term of critical or urtext editions to a maximum of 30 years following publication.)
  • Despite the foregoing points regarding the Canadian status of sections of this edition, the location Project Petrucci L.L.C. (the owner of this site) in the USA and EU complicates matters considerably. Since many volumes of the PHA were issued simultaneously in Germany and bear a proper copyright notice after 1963 (which means they were automatically renewed in the USA), they would appear to be protected under the US and EU laws until there is a challenge to clarify the "threshold of originality" with respect to such editions directly. IMSLP therefore has moved all such items to servers of the unaffiliated organization IMSLP-CA, where they are available only to Canada downloaders.
